MANOTECA — TERMS & CONDITIONS

These Terms & Conditions govern quotations, commissioned works, custom productions and sales carried out through the Manoteca website or by direct correspondence with the studio.
1. Nature of the Works
Manoteca creates handmade collectible design objects using reclaimed, antique, restored and non-industrial materials. Each object is unique or produced in limited quantities through artisanal processes. Natural irregularities, patina, chromatic variations and material imperfections are integral characteristics of the works and shall not be considered defects.
2. Orders and Quotations
The website does not operate as an automated e-commerce platform. Purchase requests are initiated through contact forms or email correspondence. Objects marked with the “Order” button may be available for purchase. Objects marked with “Ask about a custom version” are available exclusively as commissioned or custom works. Objects displayed without purchase buttons are considered non-reproducible and not available for sale.
3. Deposits and Payments
A non-refundable deposit equal to 50% of the agreed amount is required to initiate production or reserve a work. The remaining balance must be paid in full before shipment. Payments are accepted exclusively via bank transfer unless otherwise agreed in writing. Ownership of the work remains with Manoteca until full payment has been received.
4. Approval Procedure
During production, Manoteca may share updates and images regarding the commissioned work. Before shipment, the client receives final photographic documentation showing the object from multiple perspectives in neutral conditions and natural light. Written approval by the client constitutes final acceptance of the work.
5. No Right of Withdrawal
Pursuant to Article 16(c) of Directive 2011/83/EU, commissioned works, customized pieces and made-to-order objects are excluded from the statutory right of withdrawal, as they are produced according to the customer’s specifications or clearly personalized. Once final approval has been provided and shipment authorized, the order is considered final and non-returnable.
6. Shipping and Delivery
Manoteca ships worldwide using professional carriers selected according to destination and handling requirements. Delivery methods, installation services and crate disposal are agreed during the quotation process. All shipments are insured. Delivery times are indicative only and may vary depending on transportation methods, customs procedures and circumstances beyond Manoteca’s control. Import duties, customs charges, local taxes and VAT applicable in the destination country remain the sole responsibility of the client.
7. Accessibility and Installation
Clients are responsible for verifying accessibility conditions at the delivery location, including doors, staircases, elevators and installation feasibility. Additional costs arising from inaccessible premises or special handling requirements not previously communicated shall be borne by the client.
8. Damages During Transport
All objects leave the studio after inspection and in perfect condition. The client must inspect the shipment upon delivery and report visible damage within 48 hours, including photographic documentation. Replaceable works may be repaired or replaced where possible. Unique works that cannot be reproduced may be partially or fully refunded depending on the circumstances and insurance outcome.
9. Intellectual Property
All website contents, including texts, photographs, graphics, object designs, editorial materials, concepts and the “Manoteca” name and logo are protected by intellectual property laws and remain the exclusive property of Manoteca di Elisa Cavani. No content may be reproduced, copied, modified, distributed, commercially exploited or used for AI training datasets without prior written authorization.
10. Limitation of Liability
Manoteca shall not be liable for delays, interruptions or failures caused by customs procedures, transportation disruptions, force majeure events or circumstances beyond reasonable control.
11. Governing Law and Jurisdiction
These Terms & Conditions are governed by Italian law. Any dispute arising out of or related to quotations, commissioned works or sales shall be subject to the exclusive jurisdiction of the Court of Bologna, Italy, except where mandatory consumer protection laws provide otherwise.
